Privacy Policy

1. Overview

This Privacy Policy governs the collection, use, storage, and disclosure of information by Rekover ("Rekover", "we", "us", "our"), a Shopify application operated from Queensland, Australia. By installing, accessing, or using Rekover, you ("Merchant", "you", "your") agree to the terms of this Privacy Policy in full. If you do not agree, you must immediately uninstall and cease use of the application.

This Policy is incorporated into and forms part of our Terms of Service. We reserve the right to update this Policy at any time. Continued use of the application after any update constitutes your acceptance of the revised Policy.

 

2. Information We Collect

Rekover operates exclusively within the Shopify platform. We access only the data made available to us by Shopify through its authorised API in connection with the performance of our services. This includes:

    Order data (order ID, transaction ID, amounts, timestamps)

    Dispute and chargeback data passed through Shopify's API

    Store metadata required to authenticate and operate the application

We do not collect, store, or process any personally identifiable information ("PII") of your customers beyond what is strictly necessary to perform our dispute management functions. We do not collect payment card numbers, CVV codes, or full financial account details. We do not use third-party analytics, tracking, or advertising services within the application.

 

3. How We Use Information

Information accessed through the application is used solely to:

    Identify and process chargeback disputes on your behalf

    Generate and submit dispute evidence to payment processors

    Provide reporting and analytics within the application dashboard

    Maintain and improve the functionality and performance of the application

We do not sell, rent, lease, or otherwise commercially exploit your data or your customers' data to any third party for any purpose.

 

4. Data Storage and Security

All data processed by Rekover is handled in accordance with Shopify's platform security standards. We implement commercially reasonable technical and organisational measures to protect data from unauthorised access, loss, or disclosure. However, no method of electronic transmission or storage is completely secure.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REKOVER MAKES NO WARRANTY OR GUARANTEE REGARDING THE ABSOLUTE SECURITY OF ANY DATA AND ACCEPTS NO LIABILITY FOR ANY UNAUTHORISED ACCESS, DATA BREACH, OR LOSS OF DATA THAT IS BEYOND OUR REASONABLE CONTROL.

 

5. Chargeback Outcomes — Limitation of Liability

THIS SECTION IS CRITICALLY IMPORTANT. PLEASE READ IT CAREFULLY.

Rekover provides automated chargeback dispute management tools. We do not guarantee any specific outcome in connection with any chargeback dispute, including but not limited to the recovery of funds, the reversal of a chargeback decision, or the maintenance of your payment processor standing.

Chargeback outcomes are determined solely by the relevant payment processor, card network (including Visa, Mastercard, American Express, and Discover), and/or issuing bank. Rekover has no authority over, and accepts no responsibility or liability whatsoever for, any chargeback that is not resolved in your favour, regardless of the evidence submitted, the quality of our submission, or any other factor.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REKOVER EXPRESSLY DISCLAIMS ALL LIABILITY FOR:

    Any chargeback dispute that is lost, denied, or upheld in favour of the cardholder;

    Any revenue, funds, or amounts not recovered as a result of an unsuccessful dispute;

    Any fees, fines, penalties, or account consequences imposed by payment processors or card networks;

    Any account suspension, termination, or restriction by Shopify or any payment processor;

    Any indirect, consequential, incidental, special, or punitive loss or damage arising from chargeback outcomes.

Your sole remedy in the event of dissatisfaction with the application is to cease use and uninstall the application. Rekover's total aggregate liability to you under any circumstances shall not exceed the total fees paid by you to Rekover in the thirty (30) days immediately preceding the event giving rise to the claim.

 

6. No Guarantee of Results or Service Continuity

Rekover is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the application will be uninterrupted, error-free, or free from harmful components. We reserve the right to modify, suspend, or discontinue the application (or any part of it) at any time without notice and without liability to you.

 

7. Third-Party Services and Compatibility

Rekover operates independently and does not integrate with, share data with, or guarantee compatibility with any other chargeback management application or service. We expressly disclaim any responsibility for conflicts, failures, or losses arising from the concurrent use of Rekover with any other chargeback or dispute management provider.

Your use of Shopify and any payment processors is governed by their respective terms of service and privacy policies. We accept no responsibility for the actions, policies, or decisions of Shopify, any payment processor, card network, or issuing bank.

 

8. Merchant Responsibilities

You are solely responsible for ensuring that your use of Rekover complies with all applicable laws and regulations, including but not limited to the Australian Privacy Act 1988 (Cth), the Australian Consumer Law, and any applicable international data protection laws (including the GDPR where applicable to your customer base).

You represent and warrant that you have obtained all necessary consents and have the legal right to provide Shopify store access to Rekover for the purposes described in this Policy. You indemnify and hold harmless Rekover and its officers, directors, employees, and agents from any claim, loss, or damage arising from your failure to comply with applicable laws or your breach of this Policy.

 

9. Data Retention

We retain order and dispute data only for as long as necessary to perform our services or as required by applicable law. Upon uninstallation of the application, we will cease active processing of your store data. You may contact us to request deletion of any residual data held by us, subject to any legal obligations we may have to retain certain records.

 

10. Cross-Border Data Transfers

Rekover is operated from Queensland, Australia. By using the application, you acknowledge that data may be processed and stored in Australia or in other jurisdictions where data protection laws may differ from those in your jurisdiction. We take reasonable steps to ensure that any such transfers comply with applicable privacy laws.

 

11. Changes to This Policy

We reserve the right to amend this Privacy Policy at any time. Updated versions will be made available within the application or via our listed contact channel. Your continued use of the application following any amendment constitutes your acceptance of the updated Policy. It is your responsibility to review this Policy periodically.
